During this transitory period, it can be difficult to understand what smoke alarm legislation must be complied with already, and what needs to be changed by 1 January 2022. As of today, all new dwellings must have photoelectric alarms powered by main powers that are fully interconnected, meaning all new or substantially renovated buildings must already comply with the 2022 legislation.

If your current smoke alarm is 10+ years old or is faulty, it has to be replaced with a photoelectric smoke alarm compliant with AS 3786:2014. However, if it’s under 10 years old, it must comply with AS 2786:1993. It is up to tenants to test smoke alarms 12 monthly, while landlords have to install smoke alarms if necessary. 2022 legislation requires that smoke alarms be in all bedrooms, interconnected, photoelectric, AS 3786:2014 compliant, and powered by a 240-volt or 10-year lithium battery.
